Nichtveranlagungsverfügung

Nichtveranlagungsverfügung (NVV), translated as Non-Assessment Certificate in English, is an official certificate issued by the German tax authorities to individuals whose income is below the taxable threshold. This certificate exempts them from any obligation to file an income tax return or pay income tax.

The Nichtveranlagungsverfügung is particularly relevant for individuals with low incomes, students, pensioners, and unemployed individuals receiving social benefits. It serves as proof that their income is below the taxable limit set by the tax authorities.

To be eligible for a Nichtveranlagungsverfügung, an individual's total income, including capital gains, must fall below the basic tax-free allowance, also known as the "Grundfreibetrag." As of 2021, the Grundfreibetrag is set at €9,744 for single individuals and €19,488 for married couples filing jointly. If an individual's income exceeds these thresholds, they are typically required to file an income tax return.

Obtaining a Nichtveranlagungsverfügung involves a straightforward process. Individuals should visit their local tax office (Finanzamt) and complete the necessary application form, which can also be downloaded from the tax authorities' official website. The application requires providing information such as personal details, income sources, and any tax deductions or allowances applicable.

Once the tax office reviews the application and verifies the individual's income, they may issue the Non-Assessment Certificate. It is important to note that the Nichtveranlagungsverfügung is valid for one calendar year, and individuals must renew the application annually if their income remains below the taxable threshold.

Beneficiaries of the Nichtveranlagungsverfügung enjoy substantial advantages, as they are not required to file income tax returns or make tax payments. However, it's crucial to keep in mind that this certificate only covers income tax and does not exempt individuals from other tax obligations, such as value-added tax (Umsatzsteuer) on purchases or property taxes (Grundsteuer).

By obtaining a Nichtveranlagungsverfügung, eligible individuals can benefit from additional financial freedom and avoid the administrative burden of filing income tax returns.
